These Terms of Use ("Terms") govern your use of kyesclimateactionfund.com and any related pages operated by Kye's Climate Action Fund ("KCAF," "we," "us"), a California nonprofit public benefit corporation. By using this website, you agree to these Terms. If you do not agree, please do not use the site.

1. Use of this website

You may view, download, and print material from this site for your own personal, non-commercial, or educational use. You agree not to:

  • Use the site for any unlawful purpose, or in a way that could damage, disable, or impair it
  • Attempt to gain unauthorized access to any part of the site or its underlying systems
  • Use automated tools to scrape, harvest, or collect information from the site, including email addresses
  • Submit false, misleading, or fraudulent information through our forms, including in connection with a donation or grant inquiry
  • Use our name, logo, or Kye's name, image, or story to imply an endorsement, affiliation, or partnership that does not exist
  • Impersonate KCAF, our board members, our grantees, or solicit donations on our behalf without our written authorization

2. Our content and intellectual property

All content on this site — text, photographs, graphics, the KCAF name and logo, and the design and arrangement of the site — is owned by KCAF or used with permission, and is protected by copyright, trademark, and other laws. Photographs of Kye Moffat, of our board, our grantees, and our events are used with the permission of the people pictured or their families.

Except as permitted in Section 1, you may not reproduce, republish, distribute, modify, or create derivative works from our content without our prior written permission. If you would like to use our materials — for reporting, education, or to tell others about this work — please ask. We are usually glad to say yes.

3. Donations

Donations are processed by Zeffy, a third-party platform, subject to its own terms and privacy policy. KCAF does not receive or store your payment card details.

  • KCAF is a 501(c)(3) organization, EIN 93-4597470. Donations are tax-deductible to the extent allowed by law. We do not provide tax advice; consult your own advisor about your specific situation.
  • Donations are generally final and non-refundable. If you believe a gift was made in error or without authorization, contact us promptly and we will work with you in good faith.
  • Unless you have designated a gift for a specific purpose and we have agreed in writing to that restriction, KCAF retains full discretion over the use of all donated funds, consistent with our charitable mission and our obligations as a nonprofit.
  • Recurring gifts continue until you cancel them. You can cancel at any time through Zeffy or by emailing us.

4. Grants and applications

Information about grants on this site is provided for general guidance and does not constitute an offer, a promise of funding, or a contract.

  • Submitting an inquiry or application creates no obligation for KCAF to review, fund, or respond, and no relationship between us beyond what we agree to in writing.
  • KCAF may change, pause, or discontinue any grant program, eligibility criteria, deadline, or funding amount at any time and without notice.
  • All funding decisions are made at the sole discretion of KCAF and its board and are final.
  • Any grant that is awarded is governed by a separate written grant agreement, not by these Terms or by anything described on this site.
  • Do not send us confidential or proprietary information through this website. Material you submit unsolicited is not treated as confidential, and we are free to use ideas and information it contains — though we will not publish your personal information except as described in our Privacy Notice.

5. Links to other websites

This site links to websites operated by others, including partner organizations, grantees, and our donation platform. We provide these links for convenience. We do not control, endorse, or take responsibility for the content, accuracy, practices, or availability of any third-party site, and visiting them is at your own risk.

6. No professional advice

Content on this site is provided for general informational purposes. It is not legal, tax, financial, scientific, or professional advice, and you should not rely on it as a substitute for advice from a qualified professional who knows your circumstances.

7. Disclaimer of warranties

THIS WEBSITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KCAF DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the site is free of viruses or other harmful components. While we work to keep information accurate and current, we do not warrant that it is complete, accurate, or up to date, and we may change it at any time without notice.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KCAF AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THIS WEBSITE, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THIS WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

We may revise these Terms at any time by posting an updated version on this page and changing the "Last updated" date. Changes take effect when posted. Your continued use of the site after that constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or this website will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the personal jurisdiction of those courts.

12. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Notice, are the entire agreement between you and KCAF regarding this website.
